A person kept in a psychiatric establishment against his will and without grounds has been released after the Defender’s intervention

Close relative of a person kept in a psychiatric establishment has informed the Human Rights Defender's Office about a relative that is kept in a psychiatric establishment without sufficient grounds and against his/her will.

In this regard, on October 25, an unannounced visit has been made to the psychiatric establishment.

During the visit, the Defender’s representatives met with the person kept in the psychiatric establishment and examined medical documents related to that person.

The representatives of the Human Rights Defender raised the issue of the legal grounds for keeping an adult and a capable person in a psychiatric hospital against that person’s will with an absence of a procedure on compulsory treatment.

Therefore, it was required to immediately release the person from the psychiatric establishment. As a result, the person left the hospital accompanied with close relative.

Currently, the Defender’s Office is preparing a relevant decision on violation of human rights.
