Department for Legal Analysis

The Department of legal analysis of the Staff of Human Rights Defender of the Republic of Armenia:

 

  • provides the development of the considerations and recommendations on legal act drafts sent for review by the Human Rights Defender,
  • based on the complaints of the citizens addressed to the Human Rights Defender identifies the existing legislative gaps and contradictions in the current RA legislation and makes relevant legislative proposals to the competent state authorities to make the necessary amendments to the legal acts,
  • provides legal advice to citizens on their rights and freedoms, as well as on the legal measures and procedures for the effective protection of those rights and freedoms,
  • coordinates the development of public reports through analysis of the results of the visits and studies and identification of systemic problems,
  • considers the complaints submitted by citizens to appeal to the Constitutional Court of the RA, processes the applications to be submitted to the Constitutional Court of the RA, as well as provides representation in the Court,
  • reviews the complaints or reports presented by the citizens on initiating disciplinary proceedings against the judge and in case of existence of grounds stipulated by the law submits them to the Ethics and Disciplinary Commission under the RA General Assembly of Judges,
  • reviews the domestic legislation, the international experience on relevant issues (the legislation of foreign countries, court decisions, including the Constitutional Courts of other countries), the precedent decisions of the European Court of Human Rights, as well as other international documents and recommendations,
  • participates in meetings and discussions with NGOs and international organizations, representatives of state bodies, international experts and other persons,
  • participates in the development of public reports through analysis of the results of studies and identification of systemic problems,
  • within its competence cooperates with state and local self-government bodies and international organizations.
